1. Purpose
These terms of use ("Terms") govern access to and use of the website booonsai.com and the BooonsAI services. By accessing the service, you accept these Terms without reservation.
2. Publisher
The service is published by EquusChain Ltd, Al Sarab Tower, ADGM Square, Al Maryah Island, Abu Dhabi, United Arab Emirates — see the Legal Notice.
3. Access and eligibility
BooonsAI is a service giving access to third-party artificial intelligence models intended for universities and training institutions, companies and, where applicable, their end users (students, employees). Access is by invitation only; there is no open public registration. The publisher may refuse, restrict or suspend any access in the event of a breach of these Terms.
4. Services provided
- Access gateway to third-party AI models, via two routes: a sovereign route (execution in Switzerland) and a standard route (execution in the European Union).
- Metering and per-entity attribution: measurement of consumption (tokens, cost) by entity, sub-client and usage.
- Per-client quotas and API keys.
- Business agent integrator (depending on the deployed scope).
BooonsAI is not a model provider: it routes and meters.
5. Nature of AI outputs and liability
- Outputs are generated automatically by third-party models. They may be incorrect, incomplete or biased and constitute neither advice (legal, financial, medical or otherwise) nor an automated decision with legal effect.
- The user must not rely exclusively on an AI output for an important decision; it is for the user to verify the information.
- BooonsAI is not liable for content generated by third-party models, for the user's use of it, or for the unavailability of a third-party provider.
- The publisher provides the service on a best-efforts basis; its liability is limited under the applicable commercial terms.
- No certification is claimed: BooonsAI holds neither ISO 27001 nor SOC 2. Any certifications belong to third-party providers and are presented as such.
- No "end-to-end encryption" claim is made: communications are encrypted in transit (HTTPS/TLS).
6. User obligations
The user undertakes to:
- provide accurate information when creating an account;
- keep API keys and credentials confidential — any use of the keys is deemed to be made by the client;
- not use the service for illegal, fraudulent or malicious purposes;
- not submit sensitive data (health, opinions, biometrics) or third-party data without a legal basis;
- not attempt to circumvent quotas, falsify the meter, or breach the security of the service;
- not attempt to manipulate the models (prompt injection) for abuse or unauthorised extraction;
- comply with the terms of the third-party model providers.
7. Fees, quotas, API keys and payment
- Each client has quotas per period and, where applicable, personal API keys (stored hashed).
- The meter is computed server-side: the user cannot modify their role, quota or consumption.
- Pricing and payment terms (price list, payment method, VAT) are set out on the Offers page; payment is made by card through our payment provider; applicable VAT depends on the country of invoicing.
8. Intellectual property
All service content (texts, interfaces, logos, the BooonsAI and EquusChain trademarks, code, structure) is protected. Any reproduction or exploitation without prior written authorisation is prohibited. The user retains rights over the content they submit; they grant the publisher the limited technical licence necessary to process their request through third-party models.
9. Personal data
Data is processed in accordance with the Privacy Policy and the Cookie Policy, compliant with the GDPR.
10. Links to third-party sites
The service provides access to third-party models and providers. We exercise no control over these third parties and disclaim any liability for their content or practices.
11. Changes
These Terms may be amended at any time. The applicable version is the one online at the time of your use.
12. Governing law and jurisdiction
[This service is governed by the laws of Abu Dhabi Global Market (ADGM) and the United Arab Emirates. Any dispute falls under the jurisdiction of the ADGM courts.
